In plaintiff's action claiming wrongful termination from her position in the Youth Services Administration of the District of Columbia Department of Health and Human Services (DCDHS) and denial of due process in violation of her Fifth Amendment rights, dismissal of plaintiff's action is affirmed where plaintiff failed to: 1) exhaust her administrative remedies under the District Comprehensive Merit Personnel Act (CMPA) and the collective bargaining agreement (CBA) between her union and the District; and 2) petition the District Public Employee Relations Board (PERB) for relief when the District refused to arbitrate her grievance.
