Fabi Constr. Co., Inc. v. Sec'y of Labor, 06-1244
Subsequent to an action by OSHA claiming safety violations by petitioner that contributed to a construction accident, petition for attorneys' fees and costs is granted in part where: 1) billing defects required reductions in the total amount sought for attorneys' fees, costs and expenses; and 2) petitioner was not entitled to attorneys' fees, costs, or expenses spent defending issues on which the government's position was "substantially justified."
