US v. Hurt, 06-3183
A conviction and sentence for theft of government property is affirmed over claims of error regarding: 1) a refusal to deliver a requested theory-of-defense instruction; 2) omission of a special unanimity instruction requiring that all twelve jurors agree on how the theft took place; and 3) violation of defendant's Sixth Amendment right to effective assistance of counsel.
