Humane Soc'y of the U.S. v. Kempthorne, 06-5396, 06-5397
Judgment enjoining defendant's from authorizing the lethal take of any more gray wolves for depredation control purposes by the Wisconsin Dept. of Natural Resources is vacated where: 1) the case was rendered moot when the gray wolf was taken off the protected species list, and the Endangered Species Act no longer prohibits taking of the species; 2) vacatur was warranted since one of the parties seeking appellate relief was not the party responsible for mooting the case.
