United States DC Circuit

Judicial Watch, Inc. v. Fed. Bureau of Investigation, 07-5158

Denial of attorney's fees for plaintiff after it obtained two court orders under the Freedom of Information Act directing the government to release videotapes relevant to the events of September 11 is reversed where court orders like the ones at issue here render plaintiffs prevailing parties for purposes of the FOIA's attorney fee provision, and remanded to determine whether plaintiff is "entitled" to the fees.
