Smith v. Mallick, 06-7179
In dispute arising from debt collection efforts, denial of appellant's motion for relief from judgment under Rule 60(b)(5), Fed.R.Civ.P., is reversed as appellant's agreement with third party, which had been assigned the judgment against appellant, discharged the judgment against appellant.
