Singh v. George Wash. Univ Sch. of Med. & Health Scis., 06-7133
In suit by a former medical student alleging violation of the Americans with Disabilities Act for failing to accommodate her alleged learning disabilities, judgment for defendant is vacated where: 1) there was ambiguity as to whether the district court reversed an earlier finding as to plaintiff's impairment; 2) the court failed to state important factual findings and intermixed legal standards of impairment with those of substantial limitation; 3) the court refused to credit plaintiff's primary evidence of impairment; and 4) the court mischaracterized the testimony of defendant's expert witness regarding substantial limitation.
