McCarthy v. BMW Bank of N. Am., 06-7155

In Chapter 7 bankruptcy action where the estate's only asset is a 2000 BMW 328i, holding that appellee bank had perfected its security interest in the car is reversed as, under District of Columbia law, the bank did not perfect its security interest within the time required, and under 11 U.S.C. section 547(b) the trustee was entitled to avoid any transfer of interest in the car.
