Belizan v. Hershon, 06-7104
In suit brought by uncertified class of plaintiffs under sections 11 and 12(a)(2) of the Securities Act of 1933 and under section 10(b) of the Securities Exchange Act of 1934, dismissal of claims is vacated in part where the district court did not adequately explain why the plaintiffs' attempt in their Pre-Appeal Draft Complaint, submitted with a motion to reconsider the first dismissal of their complaint, was inadequate to demonstrate they could cure the deficiencies in pleading their sections 10(b) and 12(a)(2) claims.
