El-Hadad v. United Arab Emirates, 06-7075
In case brought by former employee for wrongful termination and defamation against defendant U.A.E., denial of immunity under the Foreign Sovereign Immunities Act of 1976 is affirmed as plaintiff was not a civil servant under the Act, his work did not involve the exercise of distinctively governmental power and, thus, the commercial activity exception applies. However, the judgment is reversed in part where the district court failed to discount plaintiff's future lost earnings to present value.
