Pitt v. Dist. of Columbia, 05-7157
In false arrest case, partial grant of judgment as a matter of law for defendants, after split jury verdict for plaintiffs, is reversed as to: 1) denial of defendants' motion for judgment as a matter of law on plaintiff wife's intentional infliction of emotional distress claim; 2) the sufficiency of the evidence to find one detective liable for malicious prosecution, and the punitive damage award against that detective; and 3) the court's error in holding that the defendant officers were entitled to qualified immunity on the false arrest claims.
