Natural Res. Def. Council v. EPA, 04-1385, 04-1386, 05-1302, 05-1434, 06-1065

Two separate rules promulgated by respondent agency regarding certain emission standards are vacated where: 1) respondent's definition of commercial or industrial waste, as incorporated in the definition of commercial and industrial solid waste incineration unit (CISWI) is inconsistent with the plain language of section 129 of the Clean Air Act; and 2) the National Emission Standards for Hazardous Air Pollutants for Industrial, Commercial, and Institutional Boilers and Process Heaters must be substantially revised as a consequence of the vacatur and remand of the CISWI Definitions Rule.
