US v. Bras, 05-3190
Conviction and sentence based on guilty plea to conspiracy to commit bribery and highway project fraud are affirmed over defendant's claims of: 1) Booker violations; 2) Sixth Amendment violations due to increase of sentence based upon testimonial evidence not subject to cross-examination; 3) use of unreliable evidence to calculate loss that his crime caused the government, which led to erroneous calculation of his advisory Sentencing Guidelines range; and 4) unreasonable sentence.
