In suit alleging age discrimination and retaliation, appeal from summary judgment for defendant is dismissed for lack of jurisdiction where plaintiff's notice of appeal was untimely. Appeal is dismissed even though plaintiff's attorney died, plaintiff then proceeded pro se, and was misinformed by the district court as to time to file notice.
