North Baja Pipeline LLC v. FERC, 05-1214

In case involving a rate filing by petitioner, a pipeline that transports natural gas from Arizona to Mexico through California, petition for review of decision that: 1) petitioner's proposed cost-sharing formula was inconsistent with established FERC policy, and 2) scheduled maintenance was not a force majeure event under FERC precedents, is denied as the decision is reasonable and reasonably explained.
