United States DC Circuit

Doe v. Exxon Mobil Corp., 05-7162

In case involving allegations by Indonesian villagers from Aceh that defendants' security forces committed murder, torture, assault and other torts, appeal from denial of defendants' motion to dismiss is dismissed as defendants' appeal does not fall within the narrow "collateral order" doctrine, and alternative request for writ of mandamus is denied as defendants have not established a "clear and indisputable" right to have these claims dismissed under the political question doctrine.
