Kingsmore v. District of Columbia, 05-7156
Summary judgment in favor of plaintiff, a parent of a mildly disabled minor who was dissatisfied with defendant's individual education plan for her daughter, with order to reimburse plaintiff for placing her daughter in a private school, is vacated and remanded as the district court's decision, based solely on the incompleteness of the transcript of the due process hearing on the IEP, failed to consider whether the transcript violation did substantive harm to the daughter's rights.
