United States DC Circuit

US v. Shah, 03-3070

A sentence for drug-related offenses is affirmed over claims that defendant's plea was "tainted" because his attorney was ineffective, that a preponderance of the evidence did not support an enhancement of his offense level, that insufficient evidence supported a finding regarding a conspiracy, and that a determination of defendant's base offense level was in error. However, a limited remand is ordered pursuant to Coles.
