Maine Pub. Utils. Comm'n v. Fed. Energy Regulatory Comm'n, 05-1001

Petition for review, brought by owners of electric transmission facilities and several state public utility commissions, challenging orders of the FERC conditionally approving a proposal to form a regional transmission organization in New England are denied over: 1) challenges to the FERC's authority to reject a provision of a Transmission Operating Agreement, 2) claims that rejection of the provision, and a rejection of a certain incentive adjustment were arbitrary and capricious; and 3) that approval of a certain incentive adjustment was arbitrary and capricious.
