Nix v. Billington, 04-5225

Denial of plaintiffs' motion for a status hearing on pending workplace retaliation claims for lack of jurisdiction is reversed where the district court's interpretation of the disputed orders at issue could not survive review under either a de novo or abuse of discretion standard as plaintiffs' claims were filed during the district court's oversight period, and were still pending before the court when its oversight jurisdiction under a settlement agreement expired.
