Boehner v. McDermott, 04-7203

Summary judgment for plaintiff is affirmed where undisputed facts proved that, for purposes of 18 U.S.C. section 2511(1)(a), defendant-congressional representative "unlawfully" obtained a tape recording of an illegally-intercepted conversation in which plaintiff, another congressional representative, participated.
