ENERGY SERVS., INC. v. FEDERAL ENERGY REG. COMMISSION, 03-1027

The FERC's order, finding that defendant had unreasonably discriminated against competitors by illegally keeping transmission capacity off the market, is affirmed over defendant's contentions that the finding is arbitrary and capricious.
