WALLACE v. SKADDEN, ARPS, SLATE, MEAGHER & FLOM, LLP, 03-7026

District court erred when it ignored the procedural requirements of FRCP rule 53 in adopting the report by a magistrate judge (acting as a special master) recommending a $25,000 sanction. Under rule 53, it was the district court's duty - after motion, notice, and a hearing - to review the special master's legal conclusions de novo and to review his findings of fact for clear error.
