United States DC Circuit
CRUZ v. AM. AIRLINES, INC., 03-7012
Two classes of international passengers who sustained the loss of or damage to their checked luggage are denied certification to bring Warsaw Convention claims. Individual plaintiffs lack standing to challenge the prospective enforcement of defendant's 30-day rule, and their individual damages claim was barred by the release signed in exchange for a $635 payment.
