A challenge to an FCC decision to lift a ban on specialized overlay area codes is unripe, as challenges are intertwined with how the FCC might exercise its discretion in the future. FCC decisions authorizing states to implement rationing of telephone numbers, and authorizing state auditing, were not arbitrary and capricious.
