United States DC Circuit

IN RE VITAMINS ANTITRUST CLASS ACTIONS, 02-7025

District judge did not abuse his discretion in finding that a party's neglect in failing to opt out of a settlement was excusable, thus an order granting a Motion to Modify the Final Order Approving Class Settlement in an antitrust action alleging price-fixing by vitamin suppliers is affirmed.
