BRANNUM v. LAKE, 01-5319/5405
The doctrine of Feres v. United States, 340 U.S. 135 (precluding certain actions for injuries "incident to service") poses no bar to a complaint regarding an allegedly illegal recall to active duty, which goes to whether the military had jurisdiction over plaintiff in the first place under the Uniform Code of Military Justice.
