NATIONAL MULTI HOUSING COUNCIL v. U.S. ENVIRONMENTAL PROTECTION AGENCY, 00-1159

The EPA's decision to include a "regardless of source" interpretation in it's final Lead Rule under Section 403 of the Toxic Substances Control Act, 15 U.S.C. 2683, referring to all hazardous lead-containing dust and soil, whether or not the source of the lead is lead-based paint, is neither arbitrary and capricious, nor contrary to Congress's intent.
