DOMINION RESOURCES, INC. v. FERC, 01-1031, 01-1169
Because the FERC's Compliance Order, requiring plaintiff's pipeline subsidiary to observe FERC's Standards of Conduct, 18 C.F.R. sections 161.3, 250.16, in dealing with all of its energy affiliates in a post-merger entity, was far broader than the order on which it purportedly rested, the Complaince Order is arbitrary and capricious.
