IN RE: SMITH, 01-3073

While petitioner is innocent, based upon an incorrect understanding of his conviction 18 USC 924(c) for "active employment" of a firearm during a drug transaction, he may use the savings clause of Anti-Terrorism and Effective Death Penalty Act of 1996 to invoke Section 2241 to collaterally attack his conviction before the district court.
