INTERSTATE NAT'L GAS ASSOC. OF AMERICA v. FED. ENERGY REGULATORY COMM'N, 98-1333, 98-1349
Given that competition for interstate natural gas pipeline rates has every reasonable prospect of preventing seriously monopolistic pricing, together with the non-cost advantages, like flexibility, and the experimental nature of a particular "lighthanded" regulation, FERC's decision to grant a two-year experimental waiver of the gas rate ceilings on releases of firm capacity neither violated the Natural Gas Act, nor constituted an arbitrary or capricious agency decision.
