LOMONT v. O'NEILL, 01-5104

The National Firearms Act of 1934's requirement, that owners seeking permission from the Treasury Department to make or transfer their firearms must obtain certification from a law enforcement official where they reside, is valid under the Administrative Procedures Act, and neither violates the Tenth Amendment, nor taxpayer privacy provisions under the Internal Revenue Code.
