Where sufficient similarities exist between two architectural designs, such that they may be substantially similar, plaintiff architect's infringement claim raises issues that must be resolved at trial, and where tort claims are qualitatively different from infringement claims, they are not preempted by Section 301 of the Copyright Act, and survive dismissal.
