United States Ninth Circuit

US v. King, 09-30442

In an appeal from a judgment of the district court convicting defendant of injecting fluids into deep wells without a permit, 42 U.S.C. section 300h-2(b)(2), and making materially false statement, 18 U.S.C. section 1001(a)(2), conviction and sentencing are upheld where defendant's challenges on statutory and constitutional grounds fail, and because the court correctly denied defendant's post-verdict motion for a new trial on the basis of alleged violations of a pre-trial order and prosecutorial misconduct.
