The government appealed the district court’s granting in part of a motion to enforce a 1997 settlement agreement guaranteeing minors in the custody of immigration agencies be held in facilities that are safe and sanitary. The panel dismissed the appeal for lack of jurisdiction because the district court did not modify the agreement.
