United States Ninth Circuit

USA v. Ocho, 18-10383

Reversed in part. Defendant appealed from the district court revocation of his supervised release. Defendant pled guilty to possessing child pornography and was sentenced to 78 months in prison and 120 months of supervised release with special conditions. The district court found that Defendant violated one of the special conditions of his release. The Ninth Circuit reversed the finding that Defendant violated the condition by visiting an adult themed business only once, but affirmed that the release condition was appropriate.
