United States Ninth Circuit
West v. City of Caldwell, 18-35300
Reversed district court order denying qualified immunity to police officers. Plaintiff sued alleging that police officers violated her civil rights by coercing to consent to enter and then to shoot tear gas into her home to apprehend a dangerous, potentially armed, and suicidal felon. The court found that police officers had qualified immunity because police officers thought they had consent to enter the home and there were no limitations placed on that entry.
