US v. Mixon, 18-10216

Affirmed denial of a motion for attorney fees. The Ninth Circuit held that the Defendant is eligible for attorney fees under the Hyde Amendment (18 U.S.C. § 3006A) only when egregious prosecutor conduct is vexatious, frivolous, or in bad faith. In this case there was no such misconduct by the prosecutor.
