US v. Myers, 17-30159

Vacated district court’s dismissal of speedy trial claim and remanded. Defendant was prosecuted by the state and federal government for crimes arising from the same incident. The federal government delayed its prosecution until state proceedings had concluded. The Ninth Circuit held that the delay may be a violation of Defendant’s Sixth amendment right to a speedy trial and remanded to have court apply balancing test from Barker v. Wingo, (1972) 407 U.S. 514.
