Petition for review of Board of Immigration Appeals’ denial of a motion to reopen removal proceedings based on ineffective counsel granted in part and denied in part. BIA applied a “clear probability” standard, rather than a “more likely than not” standard, when considering protection under the Convention Against Torture Act. Remanded to district court.
