Hoffmann v. L. Pulido, 18-15661
Vacated and remanded. The district court dismissed Plaintiff’s, a prisoner, lawsuit for failure to pay the filing fee. The district court reasoned that Plaintiff had filed previous suits and was disqualified from filing an action without paying the fee. The appeals court disagreed and found that not all of Plaintiff's previous filings counted as disqualifying strikes for the purpose of filing without paying the fee.
