United States Ninth Circuit

Gouveia v. Espinda, 17-16892

Held that the double jeopardy rule prevented a man from being retried for manslaughter. At his trial, the Hawaii state court judge had declared a mistrial when there was no manifest necessity to do so. Affirmed the granting of federal habeas corpus relief.
