Austin v. University of Oregon, 17-35559
Held that three male college basketball players may not proceed with their claims that the university acted with gender bias in sexual misconduct proceedings against them. On an issue of first impression in the circuit, concluded that the McDonnell Douglas evidentiary presumption does not apply at the pleading stage in a Title IX case. Affirmed a dismissal.
