United States Ninth Circuit

Lopez v. Barr, 15-72406

Held that a Notice to Appear that is defective under the Supreme Court's recent decision in Pereira v. Sessions cannot be cured by a subsequent Notice of Hearing. Granted a lawful permanent resident's petition for review, concluding that the flawed notice he received did not terminate the residence period required for cancellation of removal.
