Reversed and remanded in part. The district court denied plaintiff's ineffective assistance of counsel claim at the penalty phase. The Ninth circuit reversed stating that plaintiff's counsel's failure to promptly begin penalty phase investigation was deficient performance by the attorney. Case remanded for district court for rehearing of penalty phase or to vacate sentence of death.
