United States Ninth Circuit

Stayed a nationwide preliminary injunction that had prevented federal immigration officials from implementing the Migrant Protection Protocols. The protocols, issued in Jan. 2019, direct that many asylum applicants who arrive from Mexico must be returned there while awaiting a hearing before an immigration judge. The Ninth Circuit concluded that the plaintiffs had failed to show a likelihood of succeeding on the merits of their challenge to the protocols.
