United States Ninth Circuit

US v. Lozoya, 17-50336

Reversed an airline passenger's conviction for assaulting a fellow passenger because the prosecution should have been brought in the federal judicial district in whose airspace the assault occurred. The defendant allegedly slapped a passenger in the seat behind her who had repeatedly jostled her seat. Reversing the federal misdemeanor assault conviction, the Ninth Circuit held that the case had been prosecuted in the wrong venue.
