United States Ninth Circuit
Herrera v. City of Palmdale, 17-55761
Held that it was proper to abstain from hearing motel owners' claims that city officials violated their rights in shutting down the motel, because the city had brought a public nuisance action in state court. Abstention in the federal case was necessary under Younger v. Harris, 401 U.S. 37 (1971), with the exception of a claim alleging an unconstitutional search.
