United States Ninth Circuit

Held that an alien in removal proceedings failed to establish that he would probably be tortured if returned to Nicaragua. Also held that the Board of Immigration Appeals may consider sentencing enhancements when it determines that an alien was convicted of a per se particularly serious crime. Denied the man's petition for review.
