Fazaga v. FBI, 12-56867
Revived some of the claims brought by three Muslim residents of Southern California who alleged that the FBI conducted unlawful covert surveillance of them based solely on their religious identity. Held that the trial court should not have relied on the state secrets doctrine to dismiss some of their claims outright. Reversed a dismissal in part.
